Transsexual Files Discrimination Suit

A Transsexual pharmacist in Colorado has filed a job discrimination complaint, alleging a grocery store chain has forbidden her from wearing women's clothes to work.

Kim Dower, a male to female TS, employed at a King Soopers store, went public Tuesday with what she called her legal right, to come out 24/7, without the threat of being fired.

Dower has filed administrative charges of discrimination with the Equal Employment Opportunity Commission and Denver's Anti-Discrimination Office.

Documents state Dower was considered an exemplary employee before informing management, in March, about plans "to begin dressing like a woman in the workplace," a year before gender reassignment surgery.

Reportedly, Dower was told by her supervisor that wearing anything in the store but male clothes would be grounds for termination.

Apparently, there had been attempts to resolve the issue informally, but according to Dower's attorney, Betty Tsamis, the grocery chain demanded unrestricted access to Dower's medical and psychological records on an ongoing basis, as well as undergoing an independent medical evaluation.

Both proposals, Tsamis said, represented an unreasonable invasion of Ms. Dower's protected medical history and privacy.
